Terms of Use
Effective 8 September 2026
These terms govern access to and use of the Grobler Digital website. Separate agreements apply to commissioned client work.
Acceptance of these terms
By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the website.
Website purpose
This website provides general information about Grobler Digital and its software engineering services. Website content is not professional, legal, financial, or technical advice for your particular circumstances, and submitting an enquiry does not create a client relationship.
Acceptable use
You may use this website for lawful personal or business purposes. You may not:
- Attempt to gain unauthorised access to the website, its systems, or related services.
- Introduce malicious code, overload the service, scrape it abusively, or interfere with its operation.
- Use the contact form for spam, harassment, unlawful content, or misleading submissions.
- Copy, republish, or commercially exploit website content except as permitted by law or with written permission.
Intellectual property
Unless stated otherwise, the website design, copy, branding, graphics, software demonstrations, and other original content belong to Grobler Digital or are used under licence. All rights are reserved. Product names, logos, and trademarks belonging to third parties remain the property of their respective owners.
Client projects
Any paid project, quotation, support arrangement, licence, deliverable, or other professional service is governed by a separate written agreement or accepted proposal. If those terms conflict with these website terms, the signed or accepted project terms control for that engagement.
Third-party services and links
This website may link to third-party websites or use third-party infrastructure. Grobler Digital does not control third-party content, availability, security, or privacy practices and is not responsible for them. A link does not necessarily imply endorsement.
Availability and disclaimers
We aim to keep website information useful and accurate, but do not guarantee that all content is complete, current, error-free, or suitable for every purpose. The website may be changed, suspended, or unavailable without notice. To the extent permitted by law, it is provided on an "as is" and "as available" basis.
Liability
To the extent permitted by applicable law, Grobler Digital will not be liable for indirect, incidental, special, or consequential loss arising from use of, reliance on, or inability to use this website. Nothing in these terms excludes liability that cannot lawfully be excluded. You remain responsible for how you use website information and for protecting your own systems and data.
Enforcement and changes
We may restrict access where reasonably necessary to protect the website, users, or our rights. Where legally enforceable, you are responsible for loss caused by your unlawful use or material breach of these terms. We may update these terms from time to time, and continued use after an update means the revised terms apply from their effective date.
Governing law and contact
These terms are governed by the laws of the Republic of South Africa. South African courts will have jurisdiction, subject to any rights you have under applicable consumer protection law.
If any provision is found unenforceable, the remaining provisions continue to apply. Questions about these terms can be sent to info@groblerdigital.com.
